SUMMARY OF CIRCUMSTANCES SURROUNDING INCIDENT: Officers responded to the 800 blocks of 6th ST SW for an injury accident involving a pickup and a pedestrian.

The investigation revealed 91 yr old Carl Melby was crossing the street and stopped in the middle of the roadway. The driver of the pickup, Brent Berntsen, was traveling southbound coming over the crest of the hill.

Bernstein was unable to stop and Melby was struck while standing in the southbound lane. Melby was transported to Trinity ER where he later succumbed to his injuries.

After consulting with the Ward County States Attorney’s office, there are no pending criminal charges at this time. Bernstein was cited for the care required in the operation of a motor vehicle.
